Why Coverplan Insurance For Businesses?
- Employers are constantly exposed to unfair dismissal claims by their employees.
- The employer bears the onus to prove that a dismissal was for a fair reason and that a fair process was followed.
- Awards can be made up to an amount equal to twelve months’ of the employee’s salary.
- To take matters on review is costly – the policy limits the need for this process.
- Since the drastic amendments of tests reported in the Sidumo case, the possibility of success of a matter taken on review is very slim.
CCMA Statistics
During May 2011 a total of 13 399 disputes were referred to the CCMA. An average of 638 referrals every working day. Unfair dismissal disputes accounted for 81% of the total caseload. This means that the CCMA deals with high volumes of referrals and normally the employer needs to pay the employee an amount if the matter is settled.
What We Offer Within The Framework Of The Policy
You have access to cover of R75 000.00 or R150 000.00 per annum, depending on the needs of your business. Settlements are paid in special circumstances after consultation between the official of the Employers Organisation and Coverplan.
Our Claims Process is Simple
Once a dispute is referred to the CCMA or Bargaining Council and you were not successful you must:
- Complete the claim form and contact the Coverplan office and deliver the claim form.
- We will register a potential claim.
- You must pay the employee and we shall reimburse you.
Insurable Interest and Ambit
- Insurable Interest means that you are or were the employer of an employee who was dismissed by you and the award or ruling of the CCMA or Bargaining Council or Private Arbitration was made against you as respondent.
- The ambit of this policy will be limited to those disputes that are within the jurisdiction of the CCMA or a Bargaining Council or Private Arbitration within the boundaries of the Republic of South Africa.
To Qualify
- To qualify for these advantages you must make use of an expert from an approved Employers Organisation during the process of dismissal and at the CCMA or Bargaining Council or approved private arbitration.
- The employer or any of its representatives must consult with the Coverplan call centre before a sanction of dismissal is imposed.
- The employer must have a written contract of employment with the employee.
- Automatic unfair dismissals are not covered.
- You must provide the crisis centre with all relevant information pertaining to possible dismissal.
Exclusions
- The professional actions of unauthorised legal practitioners or your own actions, whether it is in a direct or indirect way regarding the policy or before the claim is reported, will result in no cover in terms of this policy.
- The employer has failed to act in accordance with the advice rendered by the call centre.
- A claim shall be regarded as having fallen within a specific year of cover if the incident giving rise to the claim, arose within that year, regardless of when the matter was ultimately heard on arbitration.
- Where you refused or neglected to be of assistance in providing information pertaining to your claim and the employment relationship;
- Cover in terms of this policy shall immediately be suspended if it is proven that you have failed to comply with the terms and conditions of the employment agreement or any statutory duty;
- The Insured will have the right to repudiate a claim if, in accordance with the professional opinion of an independent legal practitioner, there is no reasonable prospect of success in proceedings after a disciplinary enquiry provided by this policy was conducted.
- If an employee was dismissed without consultation with Coverplan call centre.
